A ruling imposing silent races at the Circuit Mont-Tremblant

Jim Iredale and her neighbors have prevailed against the City and the Circuit. J. Lalonde of the Superior Court declared invalid the sections of laws allowing for auto racing without silencers.

In a 68-page ruling, Judge Lalonde says invalid and inoperative items

J. Lalonde did not prohibit the operation of the circuit but determines that the races will all have to be held with cars fitted with silencers. "The City will also monitor the noise from the circuit by establishing control measures and continuous monitoring ... The sound must never exceed 92 decibels," says Mr. Jeansonne.

Justice can not be bought!

Jim Iredale believes that his group of a hundred citizens won a battle but not war against a wealthy citizen who has no respect for local people. "This decision proves that justice can not be bought, a wealthy and powerful individual has no more right to pollute ... "Says tremblantoises. In the same breath, Mr Iredale believes the landlord's Tour will appeal the decision within 30 days. Will it be supported by the City or not, it remains to be seen? But Jim Iredale believes his group can not lose this fight to the finish, a just cause, "Who will support an industry that pollutes?" Says he.

Jim wants to elected Iredale Mont-Tremblant, which have "capitulated to the blackmail of the promoter Circuit Mont-Tremblant threatening to cancel the Champ Car in 2009 if the City did not retreat on its requirements on noise. In accepting an agreement out of court while the City was going to win an injunction against the circuit, "municipal officials have given permission for harm they themselves had identified as a nuisance ..." laments Mr. Iredale.

But his greatest bitterness is to the Chamber of Commerce argues that the circuit is good for the local economy without any studies to prove it. "By its actions in this case, the Chamber of Commerce has broken social cohesion. ... Does the golfer who spends his game to hear the sound of racing cars back? No, "he says. He added in passing that the President of the Chamber of Commerce at the time, Mireille Bisson, is the joint director of the Racetrack.

Finally, Jim Iredale explains that the core of her committee will meet soon to position themselves to an injunction against the circuit and a class action for loss of quality of life for years.

Positions of the City and the Circuit

The director of Circuit Mont-Tremblant, Vince Loughran was disappointed the ruling. His boss Lawrence Stroll, the lawyers in the file itself and analyze the decision in more detail in the coming days and evaluate whether they brought the case on appeal. Towards the direction of City of Mont-Tremblant, is also analyzed and will be discussed between representatives before making any comment whatsoever. Regulations allowed the operation of the circuit without noise limits, 36 days per season. "The judge does not question the good faith of elected representatives of the City in adopting the regulations, but believes they have failed to properly manage this societal problem, adopting rules that violate the Law on Quality Environment, "said Mr. Jacques Jeansonne, counsel for the plaintiffs.

There are races that are held all over North America that require running mufflers.....

Voici le commentaire de Bob à ce propos.

Quote:
Le Circuit will appeal the judgement which means no impact this year. Note there is no impact on DE since we live within 92 dB. If the judgement is upheld it will mean no racing without mufflers. I doubt the judgement will be upheld however.
